‘Ultimate Noosa Fashion Weekend competition’ Terms and Conditions (“Terms and Conditions”)

1. By entering into the Ultimate Noosa Fashion Weekend competition (“Competition”), you agree to, and are deemed to have accepted, these Terms and Conditions.

2. Unless otherwise stated, all times and dates specified in these Terms and Conditions are times and dates in Queensland, Australia, being the Australian Eastern Standard Time (AEST).

Eligibility

3. Entry is only open to Brisbane and Sunshine Coast residents, aged sixteen (16) years and older at the time of application submission (“Eligible Entrants”). The winner must be able to attend Noosa Fashion Weekend on Sunday, November 17 at Noosa to redeem their prize in person.

4. All entries must be submitted online only at www.fashionqueensland.com.au.

5. Employees, directors and management of Noosa Fashion Weekend, and their immediate families, and its agencies associated with the Competition are ineligible.

6. The Competition applications are open from 9.00am (AEST) Wednesday 16 october, 2024 and closed from 5.00pm (AEST) Monday November 11, 2024 (“Competition Period”).

7. The winner must be available to attend the Noosa Fashion Weekend runway on November 17, 2024 to collect their prize in person.

Entry into the Competition

8. To enter the Competition, Eligible Entrants must, during the Competition Period, complete and agree to the following:

(a) visit the Fashion Weekend website page www.fashionqueensland.com.au and complete the sign-up form;

(b) follow the prompts and enter their full name, email and suburb of residence;

9. Fashion Queensland reserves the right to disqualify, at its sole discretion and without giving reasons, any entry where Fashion Queensland reasonably believes that such the entrant has breached these Terms and Conditions;

10. Any Competition entrant who engages in any unlawful conduct or other misconduct, or in any conduct which may jeopardise the fair and proper conduct of the Competition or which may harm or damage the brand or reputation of Fashion Queensland or the Competition or otherwise bring Fashion Queensland, the Competition or any of Fashion Queensland’s activities, products or sponsors into disrepute, may be disqualified at Fashion Queensland’s discretion and without giving reasons. Offending conduct may include but is not limited to conduct involving Social Media platforms. Fashion Queensland reserves all of its right and interests in respect of such disqualifying conduct, including the right to seek damages and other compensation from an offender.

11. Fashion Queensland will not be held responsible or liable for entries that are delayed, lost, corrupted, misdirected, mis-delivered, incorrect or incomplete, and such entries will be not be eligible for the Competition.

12. Fashion Queensland will not be held responsible or liable for any internet malfunction, cyber event, interference or breakdown which prevents you from entering, including but not limited to any technical malfunctions of any telephone network, computer on-line system, computer equipment or software; program malfunctions or other failures; delayed computer transactions or network connections; any errors of any kind, whether human, mechanical or electronic; any intentional or malicious interference by third parties, or any combination thereof, including, without limitation, any injury or damage to the computer of any participant or any other person related to or resulting from downloading any part of these Terms and Conditions or participating in the Competition.

Drawing the Winner

13. The Winner will be selected by Fashion Queensland using a random online generator.

14. The winner will be notified by email from laura@fashionqueensland.com.au by no later than 6.00pm (AEST) Monday November 11, 2024.

The Prize

15. Subject to clause 20, the prize package for the Competition will be:

a) Two tickets to the Noosa Fashion Weekend runway event at Sofitel Noosa Pacific on Sunday, November 17, 2024 (valued at $280)

b) Two nights’ accommodation at Sofitel Noosa Pacific including breakfast for two and valet parking, redeemable within 12 months (valued at $1400)

c) A weekend drive experience (loan vehicle) from Mercedes-Benz Sunshine Coast

d) A July carry-on suitcase (valued at $335)

e) Une Piece $500 voucher to spend at the Une Piece online store

f) La Beach ‘Power Couple’ Tan Bundle (valued at $75)

g) Jimena Alejandra ‘The Anne’ baroque pearl earrings (valued at $599)

h) Sensaura Day Spa package

16. In the event that the selected Winner fails or ceases to satisfy these Terms and Conditions, forfeits or declines their prize or fails to communicate their acceptance of the prize within two (2) days of being notified by Fashion Queensland that they are the winner, Fashion Queensland reserves the right to withdraw their selection of the winner and announce a second winner. In such case, you fully release Fashion Queensland from any claim or entitlement to the prize.

17. If there is a dispute as to the identity of a Competition entrant, Fashion Queensland’s decision in deciding who to award the prize to is final. Fashion Queensland will not under any circumstances be liable to any person in relation to any such decision, including in the event that it is later proved that an entrant has successfully misled Fashion Queensland.

18. Total prize value of the prize in this promotion is valued in excess of AUD$3500.

19. The prize is not transferable or exchangeable and cannot be taken as cash. The prize is not redeemable for cash or other goods and services.

20. Fashion Queensland will not be held responsible or liable for prize(s) that are delayed, postponed, lost, cancelled, delayed, misdirected, mis-delivered or expired. Fashion Queensland will not under any circumstances be responsible for or liable in respect of any acts or omissions of any third parties, including those of sponsors or suppliers of any part of the prize.

21. Fashion Queensland may, at is discretion, vary all or any part of the prize at its discretion and Fashion Queensland accepts no responsibility for any such variation, including any variation in the prize values.

22. Prize is redeemable until November 30, 2025, Subject to availability.

Black-out Dates such as Public Holidays and some school holidays apply. It is best to check availability prior to booking.

The voucher must be taken by the validity date and cannot be extended.

The voucher must be used in one visit – no credit can be given.

23. No cash alternative or transfers available. Voucher valid until 30/11/2025. We will require a copy of a current valid drivers licence and a second form of ID. Minimum driver age is 25 years old for insurance purposes. Offer is subject to vehicle availability and we will require one weeks notice to organise the vehicle for your selected weekend. Kilometre restrictions apply. Vehicle image for illustrative purposes only.

General

24. By entering this competition, you agree that the decisions of Fashion Queensland in all matters regarding this Competition are final and binding.

25. By participating and entering the Competition, you agree that Fashion Queensland collects your information for marketing purposes. Your name and email address will be added to the Fashion Queensland database and shared with our competition partners Une Piece, Jimena Alejandra, La Beach, Mercedes-Benz Sunshine Coast and Sansaura Day Spa.

26. This competition is in no way sponsored, endorsed or administered by, or associated with Meta. Eligible Entrants understand and agree that they are providing their information to Fashion Queensland and not to Meta. By entering this competition, each Eligible Entrant releases Meta from any action or claim arising out of the competition. Any queries, comments or complaints regarding this Competition are to be directed to Fashion Queensland, not to Meta.

27. By participating and entering the competition, you agree that Fashion Queensland and those involved in the development, production (including prize suppliers), implementation and distribution of this Competition and their respective parent companies, affiliates, subsidiaries, service providers, and agencies, and their directors, officers, agents, employees, attorneys, and any other person or entity associated with such entities and/or promotion (hereinafter collectively called “Promoters”), shall not, to the fullest extent permitted by law, be liable for any claims, damages, losses or injuries, including any third party claims, arising from or relating to, in whole or in part, this Competition, including entry and participation in this Competition and acceptance, possession, use or misuse of the prize. You further agree that in the event of any third-party claims, damages, losses or injuries, arising from or relating to your participation in this Competition or participation in or use of any part of the prize, to the fullest extent permitted by law you indemnify and hold Fashion Queensland and the Promoters harmless from and against any and all such claims, including legal fees related thereto.

28. Fashion Queensland reserves the right, in its sole discretion, to cancel or suspend this Competition for any reason, including in the event that cyber events, viruses, bugs or other causes beyond its control corrupt the proper administration or security of the Competition or information collected in connection with the Competition.

29. Fashion Queensland reserves the right to modify these Terms and Conditions in any way and at any time. Fashion Queensland will endeavour to provide reasonable notice to you of any such modifications.

30. This Competition is severable and void to the extent that it is prohibited by law and is subject to all relevant legislative requirements, including, without limitation, federal and state laws and regulations.

31. Fashion Queensland does not warrant or guarantee the fitness for purpose, merchantability, functionality or suitability of any part or all of the prize.

32. This Competition shall be governed by the laws of Queensland, Australia. By participating in this Competition, you agree that the laws of Queensland, Australia, shall have jurisdiction over any dispute or litigation arising from or relating to this Competition.
